Elder Law
As a member
of the National Academy of Elder Law Attorneys, Mark A. Hyjek is
dedicated to the highest standard of competency and knowledge in
issues affecting the elderly. Within the scope of elder law.
Mark A. Hyjek
focuses on planning for incapacity and death, spousal impoverishment
issues, eligibility for MediCal and other public benefits, as well
as "standard" estate planning matters for the elderly. Mark A. Hyjek
strives for sensitivity and concern for the ethical and confidential
considerations peculiar to elder law.
In November
1994, Mark joined a select group of Elder Law Attorneys in taking
the first examination to become a Certified Elder Law Attorney.
When the examination results were announced in Spring 1995, Mark
became one of the first Certified Elder Law Attorneys in the entire
United States. The certification comes from the National Elder Law
Foundation and is approved by the American Bar Association.
Estate Planning
Mark A. Hyjek
provides complete services in estate planning, from simple Wills
to revocable living trust packages. The firm uses a comprehensive
approach to develop a complete plan for the client. Clients direct
the process, and no preconceived notion exists as to the particular
legal tools which will be employed in the plan. Clients receive
a written commitment of work to be done and the exact amount of
charges to be incurred. Mark possesses considerable experience in
the estate planning needs for all individuals and families, and
especially families with incapacitated, disabled or elderly members.
Probate
and Alternatives
Where advance
planning to avoid probate is not done, Mark A. Hyjek applies his
considerable experience to assist families to determine quickly
whether formal probate or one of the numerous alternative procedures
can be employed to accomplish the transfer of assets. Regardless
of the procedure used, work is done in an orderly, efficient and
economical manner.
Due to the increased
popularity of living trusts, many estates may now be settled without
the need for formal probate. Mark has developed considerable expertise
in post-mortem trust administration and can assist families in completing
this process.
Conservatorships
and Guardianships
When appropriate,
these Court proceedings remain as viable, protective options. Mark
has assisted numerous families through the often difficult process
of obtaining the necessary Court orders, with a high level of efficiency.
An area of particular emphasis and experience is in establishing
limited conservatorships for developmentally disabled individuals.
